The issue of child custody is one of the most important issues that has to be decided in a divorce or paternity action.  There can be full custody of the child/children to one parent or joint custody with the physical residence of the child/children being with one parent or split between the parents.  The court also will have to address the issue of visitation rights of the non-custodial parent or non-residential parent.  Hopefully, the parties will be able to agree between themselves as to the custody issues.

If the parties cannot agree on child custody than the court will have to consider what is in the best interest of the child/children.  In a contested custody case the Court will normally appoint an attorney for the child/children to protect their interests and provide input to the Court.  The Court may also request psychiatric evaluations of both parents.

The issue of child custody is to be determined within eighteen (18) months of the case being filed with the Court.
