PRE-NUPTIAL AGREEMENT

A pre-nuptial agreement is an agreement entered into between two parties contemplating marriage which discloses each party's assets and provides for the distribution of said assets and may address the issue of maintenance (alimony) if the parties should obtain a divorce at a later date.  A pre-nuptial agreement (of course) is executed prior to the marriage of the parties.  In order for a pre-nuptial agreement to be enforceable it is advisable that each party be represented by an attorney who will review the contract with his client and sign the agreement indicating that he has given the individual legal advice.  It is very likely that the court will not enforce a pre-nuptial agreement where one of the parties is not represented by an attorney at the time of its execution

Even if a pre-nuptial agreement provides for the waiver of maintenance (alimony) if the parties should divorce, the Court may find said provision unconscionable and award a spouse maintenance based upon the financial circumstances of the parties.  At least if there is a pre-nuptial agreement which provides that both parties are waiving maintenance (alimony) there is a very good argument that it would be unconscionable not to enforce the agreement because the consideration for said agreement was the parties marriage to each other.  This provides you with much better odds that said provision will be enforced versus not having said agreement and taking your chances when you divorce later on.

My minimum retainer fee to prepare a pre-nuptial agreement is $500.00.

Hire an experienced attorney and get it done right the first time and make sure that your rights are protected.  Depending on the case and the pleadings involved, an experienced attorney may be able to complete the work twice or three times faster saving the client time and money.
