Some people cringe when they hear the word probate but the probate court is there to protect everyone and to make sure that a person's will is complied with or if there is no will that the person's relatives receive their fair share pursuant to the law of intestate succession.  There would be chaos if there wasn't a probate court to make sure that a decedent's assets are not properly divided between the parties.

If a person holds property in joint tenancy, then said property will pass to the other party without going through probate.

In most cases where the total property value of the deceased is less that $50,000, I can prepare a Small Estate Affidavit for you which will transfer the property to the heirs without going through probate.  My retainer fee for a simple Small Estate Affidavit is $500.

I am available to probate an estate or to contest a will and my retainer fee varies upon the complexity of the case and the issues raised by the parties.  In many cases a small retainer fee is paid to the attorney upfront and the remainder of the attorney's fees is paid out of the estate.
